These Terms and Conditions (“Terms”) govern your access to and use of the DermapleX website, including dermaplex.com.au (“Website”), and your purchase and use of products supplied by Dermaplex Pty Ltd (“DermapleX”, “we”, “us” or “our”).

By accessing our Website, creating an account, placing an order or purchasing products from us, you agree to these Terms.

If you do not agree with these Terms, you should not use the Website or purchase products through it.

These Terms are governed by the laws of New South Wales, Australia, subject to any rights you have under applicable Australian law.

2. Eligibility to Purchase

By placing an order, you represent that:

  • the information you provide is accurate and complete;
  • you are legally capable of entering into a binding agreement;
  • you are authorised to use the payment method supplied; and
  • your purchase is for lawful purposes.

We may refuse or cancel an order where reasonably necessary, including where we reasonably suspect fraud, unauthorised payment, pricing or inventory errors, misuse of promotions, or unlawful activity.

If we cancel an order after receiving payment and no product is supplied, we will refund the relevant amount.

3. Product Information

We take reasonable care to ensure that product descriptions, photographs, ingredients, directions, sizes, pricing and other information displayed on our Website are accurate.

However, product packaging, appearance, colour, texture and other characteristics may vary slightly between batches or from images displayed on different screens.

Product images are provided for illustrative purposes and may not always perfectly represent the physical appearance of a product.

Where there is a material discrepancy or an error affecting your statutory rights, nothing in these Terms limits the rights or remedies available to you under the Australian Consumer Law.

4. Cosmetic Results and Individual Variation

DermapleX products are designed to support cosmetic hair, scalp and skincare routines according to the intended use of the relevant product.

Individual experiences and cosmetic results vary.

The outcome experienced by an individual may be affected by numerous factors, including their skin or scalp characteristics, age, genetics, lifestyle, environment, frequency and consistency of use, other products used, application technique and other individual circumstances.

Unless expressly required by law or expressly stated by us as a substantiated product guarantee, DermapleX does not guarantee that a product will produce a particular cosmetic outcome for every individual.

The absence of a customer's desired cosmetic result does not, by itself, establish that a product is faulty, defective or unsuitable for its disclosed purpose.

Nothing in this section excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

5. Before-and-After Images, Testimonials and Reviews

Any testimonials, customer reviews, photographs, before-and-after images, case studies or examples displayed by DermapleX represent the experience or appearance of the particular person depicted.

They are not a representation, warranty or guarantee that another customer will experience the same or substantially similar outcome.

Results vary between individuals.

Where photographs have been supplied by customers, influencers, manufacturers or other third parties, DermapleX may rely on information supplied to us regarding those photographs, subject to our obligations under applicable law.

We do not guarantee that testimonials or examples are representative of the results every customer will experience.

6. General Product Disclaimer

Information provided through the Website is general product and cosmetic information only unless expressly stated otherwise.

It is not intended to constitute medical advice, diagnosis or treatment and should not be relied upon as a substitute for advice from an appropriately qualified healthcare professional.

If you have a medical condition, skin disorder, scalp disorder, allergy, are taking medication, are pregnant or breastfeeding, or have concerns about whether a product is appropriate for you, seek appropriate professional advice before use where relevant.

If you experience significant or persistent irritation or an adverse reaction, discontinue use and seek appropriate professional advice where necessary.

7. Product Use

Customers must:

  • read the product label and instructions before use;
  • use products only for their stated or reasonably intended purpose;
  • follow applicable warnings, precautions and storage instructions;
  • not use products after their stated expiry or recommended period after opening where applicable; and
  • discontinue use where instructed or where an adverse reaction occurs.

DermapleX is not responsible for loss caused by misuse or use contrary to clearly provided instructions to the extent permitted by law.

This does not exclude liability that cannot lawfully be excluded.

8. Skin and Scalp Sensitivity

Skin and scalp responses vary between individuals.

Cosmetic products may contain ingredients to which particular individuals are sensitive.

Where appropriate for the relevant product, customers should review the full ingredient list before use and follow any patch-testing directions provided with that product.

A person with known allergies or sensitivities is responsible for reviewing the disclosed ingredients and seeking professional advice where appropriate.

Nothing in this section limits rights arising from an undisclosed ingredient, unsafe product, defective product, incorrect labelling or any other matter protected by applicable law.

9. Microneedling and Derma Roller Products

DermapleX derma rollers and similar accessories must be used strictly in accordance with the instructions supplied with the relevant product.

Users must not intentionally apply such products to broken, infected, severely irritated or otherwise contraindicated skin where the product instructions advise against such use.

Products should not be shared between individuals.

Customers are responsible for following cleaning, hygiene, storage and replacement instructions supplied with the product.

Excessive pressure, excessive frequency, poor hygiene or use contrary to instructions may increase the risk of irritation or injury.

If you are uncertain whether microneedling is appropriate for your circumstances, seek advice from an appropriately qualified healthcare professional before use.

10. No Medical Relationship

Purchasing a DermapleX product, communicating with our customer service team or reading information on our Website does not create a doctor-patient, healthcare practitioner-patient or other professional medical relationship.

Our customer service representatives cannot diagnose medical conditions or prescribe treatment.

11. Prices

Unless otherwise stated, prices displayed on our Australian Website are in Australian dollars (AUD) and include GST where applicable.

Prices may change from time to time.

A price change does not affect an order that we have already accepted, except where permitted by law or where there has been an obvious pricing error.

12. Orders

Submitting an order constitutes an offer to purchase the products in that order.

We may send an acknowledgement confirming that we have received your order. Receipt of an order acknowledgement does not necessarily mean an order has been accepted.

An order is accepted when we confirm acceptance or dispatch the goods, depending on our ordering process.

We reserve the right to reasonably limit quantities or refuse orders where necessary for fraud prevention, stock management, promotional integrity or other legitimate business purposes.

13. Payment

Payment must be made using a payment method available at checkout.

Depending on availability, payment methods may include credit/debit cards, PayPal, Shop Pay or other third-party payment providers.

Payment services may be subject to additional terms imposed by the relevant payment provider.

You must provide accurate billing and payment information.

14. Promotions and Discount Codes

Promotional offers are subject to any specific conditions stated with the promotion.

Unless otherwise stated:

  • promotional codes cannot be exchanged for cash;
  • promotions are available only during the stated promotional period;
  • only eligible products qualify;
  • discounts cannot necessarily be combined; and
  • promotions may be subject to stock availability.

Where DermapleX offers a “Buy 4, Get the 5th Free” promotion, unless otherwise specified, the customer must add five eligible products to their cart and the lowest-priced eligible product will be discounted to $0.

We may refuse promotional benefits where we reasonably determine that a promotion has been manipulated, fraudulently used or used contrary to its disclosed conditions.

15. Shipping

Orders are shipped to the delivery address supplied by the customer.

Estimated delivery periods are estimates only unless we expressly guarantee a particular delivery date.

Delivery may be affected by circumstances outside our reasonable control, including carrier delays, weather, public holidays, customs processing or disruptions to transport networks.

Customers are responsible for ensuring that the shipping address entered at checkout is accurate.

Contact us as soon as possible if you notice an address error. We cannot guarantee that an address can be changed after an order has entered fulfilment.

16. Risk and Delivery

Risk in goods passes as determined by applicable Australian law.

Where tracking indicates delivery but you have not received the parcel, contact us promptly so that we can investigate with the relevant carrier.

Nothing in this section limits any rights you have under Australian law regarding delivery of goods.

17. Returns and Change of Mind

Any change-of-mind return rights offered by DermapleX are additional to your rights under the Australian Consumer Law.

For hygiene and safety reasons, we may decline change-of-mind returns for products that have been opened, used, unsealed or otherwise cannot reasonably be resold, where permitted by law.

Our separate Returns & Refund Policy forms part of these Terms.

Nothing in our change-of-mind policy limits your rights where a product fails to comply with a consumer guarantee.

18. Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

Depending on the circumstances, you may be entitled to a replacement, refund, repair or other remedy where goods fail to satisfy applicable consumer guarantees.

Nothing in these Terms is intended to exclude, restrict or modify any right, guarantee, condition, warranty or remedy that cannot lawfully be excluded, restricted or modified.

Where these Terms conflict with a mandatory right under the Australian Consumer Law, the mandatory right prevails.

This is important because Australian businesses cannot use website terms or a “no refunds” policy to remove consumers' statutory guarantees.

19. Incorrect, Damaged or Faulty Products

If you receive an incorrect, damaged or potentially faulty product, contact us at [EMAIL] and provide your order number and reasonable details of the issue.

We may request photographs or other reasonable information to help assess the issue.

Any remedy will be provided in accordance with the Australian Consumer Law and any additional rights offered under our Returns & Refund Policy.

20. Limitation of Liability

To the maximum extent permitted by law, DermapleX excludes liability for indirect, incidental or consequential loss arising from use of the Website or products where such liability may lawfully be excluded.

We are not responsible for loss arising solely from:

  • use contrary to product instructions or warnings;
  • unreasonable misuse;
  • unauthorised modification of a product;
  • failure to observe clearly communicated precautions; or
  • circumstances outside our reasonable control,

to the extent permitted by applicable law.

Nothing in these Terms excludes, restricts or modifies liability, consumer guarantees or remedies that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or other applicable legislation.

21. Website Information

We endeavour to keep Website information accurate and current.

However, to the extent permitted by law, we do not warrant that the Website will always be uninterrupted, error-free or continuously available.

We may correct typographical errors, inaccuracies and omissions and make reasonable updates to Website content.

22. Intellectual Property

Unless otherwise stated, all intellectual property appearing on the Website, including the DermapleX name and branding, logos, graphics, photographs, product imagery, packaging designs, text, videos, Website design and original content, is owned by or licensed to Dermaplex Pty Ltd.

You may access the Website for personal, non-commercial purposes.

You must not reproduce, distribute, modify, republish, commercially exploit or create derivative works from our protected material without our prior written permission, except where permitted by law.

23. User-Generated Content

If you submit a review, photograph, video, testimonial or other content to DermapleX, you confirm that you have the right to submit that content.

Where you expressly authorise us to use such content, you grant DermapleX a non-exclusive licence to reproduce and display it for the purposes communicated to you, subject to applicable law.

You must not submit unlawful, defamatory, fraudulent, infringing or misleading content.

We may moderate or remove content where reasonably necessary.

24. Third-Party Services and Links

The Website may contain links to or integrations with third-party services such as Shopify, payment processors, social-media platforms and delivery providers.

Those third parties may have their own terms and privacy practices.

DermapleX is not responsible for third-party websites or services except to the extent responsibility cannot lawfully be excluded.

25. Privacy

Our collection and handling of personal information is described in our Privacy Policy.

Where the Privacy Act 1988 (Cth) and Australian Privacy Principles apply to DermapleX, we will handle personal information in accordance with those requirements.

The APPs regulate matters including collection, use, disclosure, security, access and correction of personal information.

Our Privacy Policy should be read separately from these Terms.

26. Electronic Communications and Marketing

By providing contact information, you agree that we may send communications necessary to process orders and administer our relationship with you.

Marketing communications will be sent subject to applicable Australian law and your communication preferences.

Where required, marketing communications will provide an appropriate means of unsubscribing.

27. Fraud and Misuse

You must not:

  • use the Website unlawfully;
  • attempt to interfere with its operation or security;
  • make fraudulent purchases;
  • use stolen or unauthorised payment information;
  • manipulate promotions or discount systems;
  • scrape or reproduce Website content without permission; or
  • impersonate another person.

We may suspend access, cancel affected transactions or take other reasonable action where we reasonably believe fraudulent or unlawful conduct has occurred, subject to applicable law.

28. Force Majeure

To the extent permitted by law, DermapleX will not be liable for delay or failure caused by circumstances outside our reasonable control, including natural disasters, fires, floods, industrial disputes, government action, transport disruption, telecommunications failures, pandemics or major supply-chain disruption.

This clause does not remove statutory rights that cannot lawfully be excluded.

29. Changes to These Terms

We may update these Terms from time to time to reflect changes to our business, Website, products or applicable laws.

The current version will be published on our Website with an updated revision date.

Changes will not retrospectively remove rights already accrued under an existing transaction where doing so would be unlawful.

30. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be read down to the extent necessary where legally possible.

The remaining provisions will continue to operate.

31. No Waiver

If DermapleX does not immediately enforce a provision of these Terms, this does not necessarily constitute a waiver of our right to enforce that provision later.

32. Governing Law

These Terms are governed by the laws applicable in New South Wales, Australia.

Subject to any rights a consumer has to bring proceedings elsewhere under applicable law, the parties submit to the jurisdiction of the courts and tribunals having jurisdiction in New South Wales.
